Approve Village Board Minutes May 12, 2010
- Sue @ 14:56 CST The Village of Baldwin opened their Regular Meeting on Wednesday, May 12, 2010 in the Baldwin Municipal Center, 400 Cedar St., at 6:30 p.m. Present at roll call: President Don McGee, Trustee Greg Larson, Trustee Claire Stein, Trustee Kevin Brathol, Trustee Doug Newton, Trustee Duane Russett and Trustee Willy Zevenbergen. Also present: Engineer Stoffel, Attorney Schumacher, Administrator Glockzin, Police Chief Widiker, PW Director Traxler, EMS Chief Nelson and Deputy Treasurer Suckow. Trustee Stein moved and was seconded by Trustee Larson to approve the bills to pay dated May 12, 2010. Motion passed unanimously. Trustee Newton moved and Trustee Stein seconded to approve street closure on June 56 for Grand Opening for Motorcycle Leathers and More from 8th Avenue to the end street to the North. Motion passed unanimously. Trustee Zevenbergen moved and Trustee Larson seconded to approve temporary liquor operator license for Rick Coltrain, Cheri Coltrain and Samantha Coltrain for June Bug Days, June 10-13. Motion passed unanimously. Trustee Larson moved and Trustee Brathol seconded to approve the May Financial reports. Motion passed unanimously. Public request to be placed on agenda by Dustin Jamison, Streamline Auto was held as Mr. Jamison was not present. Board reviewed liquor license applications and made recommendations for updates. BP turned in their application late, however Attorney Schumacher recommended for Board to approve at the June meeting with the other applications. Administrator Glockzin presented the Proposals for the Residential Refuse and Recycling Collections contract by Murtha Sanitation, Waste Management and Veolia. President McGee shared his role and review of the proposals. Administrator Glockzin presented a formula where each proposal was rated. The initial ratings were 58 points to Waste Management, 42 to Murtha Sanitation, and 59 to Veolia. After discussion and review by Board and contractors’ representatives, scoring ended with 62 to Waste Management, 65 to Murtha Sanitation and 61 to Veolia. Scores were all within 10% of each other so Board determined all proposals were comparable. Trustee Brathol moved and Trustee Larson seconded to accept Murtha Sanitation’s proposal for the Residential Refuse and Recycling Collections contract. Motion passed with yes votes by President McGee, and Trustees Larson, Brathol, Newton, and Zevenbergen. Trustee Stein voted no. Motion passed. Attorney Schumacher questioned the Board’s process for approval of the site plan for the I-94 industrial park. President McGee responded the Board’s approval would be based on contingency for development agreement. Roger Humphrey explained the site plan. Trustee Russett arrived at 7:35 p.m. Engineer Stoffel expanded on the site plan, to include issues of tree species, drainage numbers, pond expansion, and developer’s agreement with the village. Trustee Zevenbergen moved and Trustee Larson seconded to approve the site plan for I-94 Industrial Park with contingencies of expanded tree species, sufficient hydraulics, expansion of the pond done by the Village and approved developer’s agreement with the Village. Motion passed with yes votes by President McGee, and Trustees Larson, Stein, Newton, and Zevenbergen. Trustee Brathol voted no. Departments’ Reports: Public Comments: None presented. Board Report: Old Business: At 7:51 p.m. Trustee Newton moved and Trustee Larson seconded to go into closed session under Wis. Stat. 19.85(1)(e) deliberating/negotiating public business of a competitive nature. A roll call vote was made for Yes by President McGee, and Trustees Larson, Newton, Stein, Zevenbergen, Russett, and Brathol. The Board came out of closed session at 8:37 p.m.. Trustee Zevenbergen moved and Trustee Russett seconded to adjourn the meeting. Motion passed unanimously. Trustee Newton moved and seconded by Trustee Brathol to approve public dance license, temporary class B / Class B retailer’s license, street closure for parade on June 12 for the June Bug Days June 10-13. Motion passed unanimously. Motion passed unanimously.
Trustee Larson moved and Trustee Brathol seconded to approve permit to purchase fireworks for June Bug Days, June 12.
Trustee Zevenbergen moved and Trustee Brathol seconded to approve final 2009 budget amendments. Motion passed unanimously.
Trustee Larson moved and Trustee Zevenbergen seconded to approve the April 14 regular meeting minutes. Motion passed unanimously.
Trustee Brathol moved and Trustee Zevenbergen seconded to approve the April 28th special meeting minutes. Motion passed unanimously.
Trustee Zevenbergen moved and Trustee Larson seconded to approve payment request #6 to Pember for $6,809.16. Motion passed unanimously.
Trustee Stein moved and Trustee Larson seconded to waive the building permit fees for Baldwin Woodville High School concession stand/storage facility for $180.00. Motion passed unanimously.
Public Works – PW Director Traxler informed the Board the repair to 220th will be shared by the entities who own sections of the road that will be repaired by the County. Engineer Stoffel has reviewed the County’s plan for repair and Village’s portion of the street. Village approval to pay for the repair will be made when get the bill from the County.
Ambulance- EMS Chief Nelson stated National EMS week is May 16-23.
Police- Police Chief Widiker shared he is working with the Village’s attorney to address the public nuisance violation with a vacant house in the village.
Administration- No report.
President McGee informed the Board the parking issue at the Ambulance building was being addressed.
President McGee asked Board members to review the trees and the trees appear to be healthy according to Brent Ackley.

NOTICE OF ADJOURNMENT OF BOARD OF REVIEW
VILLAGE OF BALDWIN
The Board of Review met and adjourned on Wednesday, May 12, 2010 at 6:25 PM, until Wed., July 21, 2010 because the assessment roll was not completed. The Board of Review will reconvene on Wed., July 21, 2010 from 6:00 PM to 8:00 PM at the Baldwin Community Center, 400 Cedar Street for the purpose of examining the assessment roll and correcting all apparent errors in description or computation, to add all omitted property. Open Book is scheduled for Wed., July 21 2010 from 3:00 PM to 6:00 PM.
Please be advised of the following requirements.
-No person shall be allowed to appear before the Board of Review, to testify to the Board by telephone or to contest the amount of any assessment of real or personal property if the person has refused a reasonable written request by certified mail of the assessor to view such property.
-After the first meeting of the board of review and before the Board's final adjournment, no person who is scheduled to appear before the Board of Review may contact, or provide information, to a member of the board about that person's objection except at a session of the Board.
-No person may appear before the Board of Review, testify to the board by telephone or contest the amount of any assessment unless, at least 48 hours before the first meeting of the Board or at least 48 hours before the objection is heard if the objection is allowed because the person has been granted a waiver of the 48 hour notice of an intent to file a written objection by appearing before the Board during the first two(2)hours of the meeting and showing good cause for failure to meet the 48 hour notice requirement and files a written objection, that person provides to the Clerk of the Board of Review notice as to whether the person will ask for removal of any Board members and, if so, which member will be removed and the person's reasonable estimate of the length of time that the hearing will take.
-When appearing before the Board of Review, the person shall specify, in writing, the person's estimate of the value of the land and of the improvements that are the subject of the person's objection and specify the information that the person used to arrive at that estimate.
-No person may appear before the Board of Review, testify to the Board by telephone or object to a valuation; if that valuation was made by the Assessor or the Objector using the income method; unless the person supplies to the assessor all of the information about income and expenses, as specified in the manual under Sec. 73.03 (2a) of Wis. Statutes, that the Assessor requests. The Village of Baldwin has an ordinance for the confidentiality of information about income and expenses that is provided to the Assessor under this paragraph and shall provide exceptions for persons using the information in the discharge of duties imposed by law or of the duties of their office or by order of a court. The information that is provided under this paragraph, unless a court determines that it is inaccurate, is not subject to the right of inspection and copying under s. 19.35(1) of Wis. Statutes.
-The Board shall hear upon oath, by telephone, all ill or disabled persons who present to the Board a letter from a physician, surgeon, or osteopath that confirms their illness or disability. No other persons may testify by telephone.
-Anyone wishing to file an objection must contact their municipal Clerk to complete and submit the required objection form, prior to appearing before the Board of Review. Objections will be scheduled to be heard by the Board in the order in which they are received by the Clerk or as previously set by appointment.
